These Terms & Conditions govern your use of Elodie Couture and the purchase of products from our website.

By accessing or purchasing from our website, you agree to be bound by these Terms.

Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law (ACL).

1. Definitions

ACL means the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Consumer means a person acquiring goods or services for personal, domestic, or household use.

We, Us, Our refers to Elodie Couture.

You refers to the customer or website user.

Products refers to goods offered for sale on our website.

2. Applicability

These Terms apply to:

  • All offers made on our website

  • All orders placed by consumers

  • All agreements concluded via our online store

If any provision is found to be invalid, the remaining provisions remain in effect.

3. The Offer

We make every effort to ensure product descriptions, pricing, and images are accurate.

However:

  • Product images are for illustrative purposes only

  • Colours may vary depending on your screen

  • Obvious errors or pricing mistakes are not binding

We reserve the right to modify or withdraw offers at any time before acceptance.

4. Orders & Contract Formation

A contract is formed when:

  • You place an order; and

  • We confirm acceptance via email

We reserve the right to refuse or cancel an order where:

  • A product is unavailable

  • There is a pricing error

  • Fraud or unauthorised activity is suspected

All orders are subject to availability.

5. Pricing

All prices are listed in Australian Dollars (AUD) unless otherwise stated.

Prices include GST where applicable.

We reserve the right to change prices at any time prior to order confirmation.

If a pricing error occurs, we are not obligated to supply the product at the incorrect price.

6. Payment

Payment must be made at checkout using approved payment methods.

If payment is declined or reversed, we may cancel the order.

You must ensure all billing information is accurate and current.

7. Delivery

Delivery timeframes are estimates only and not guaranteed.

Risk of loss or damage passes to you upon delivery to your nominated address.

If a product is unavailable after purchase, we will notify you and provide a refund or alternative option.

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to:

  • A replacement or refund for a major failure;

  • Compensation for reasonably foreseeable loss or damage;

  • Repair or replacement if goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms limits your rights under the ACL.

9. Change of Mind Returns

We offer a 30-day change of mind return policy.

To qualify:

  • The item must be unused

  • In original condition and packaging

  • Proof of purchase must be provided

Return shipping costs for change of mind returns are your responsibility.

Refunds will be processed once the returned product is received.

10. Warranty & Liability

We guarantee products comply with the contract description and ACL requirements.

To the extent permitted by law:

  • We are not liable for indirect or consequential losses

  • Our liability is limited to repair, replacement, or refund

Manufacturer warranties do not limit your ACL rights.

11. Intellectual Property

All website content including logos, images, text, and branding remains our intellectual property and may not be used without permission.

We aim to respond within 14 days.

13. Governing Law

These Terms are governed by the laws of Australia.

Any disputes will be subject to the jurisdiction of Australian courts.
